  • This Platform is entitled to assign this Agreement, and all rights and obligations hereunder, to a successor to all or any of its assets, whether by sale, merger or otherwise. These terms shall be binding upon and shall inure to the benefit of the parties hereto and their respective representatives, heirs, administrators, successors and permitted assigns except as otherwise provided herein.
  • This Platform reserves the right to update, change, modify, add or remove the terms, conditions and notices of the Agreement without any prior notice to you. It is your responsibility to periodically review the most current version of the Agreement as your continued use of this Platform signifies your acceptance of any changed terms. As long as you comply with these Terms & conditions, we grant you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Platform.

This Platform provides its need fulfilment platform as a service to enable its Users to connect with businesses in their city and to boost your business to the next level in the digital world with a budget-friendly Business website service. Please keep in mind that local business listings and other elements of service need fulfilment are posted not by this Platform, but members (Users & Service Provider)s of this Platform.

Membership Eligibility (User & Service Provider)

You confirm that you are of legal age i.e. 18 years to form a legally binding contract with KhojBiz and are not a person barred, from availing the services offered by KhojBiz under the laws as applicable in India.

KhojBiz requires registration for those who participate in a variety of its services. When you authenticate your email or mobile number for using the local service need platform and register as a member on this Platform, you accept the following terms and conditions:

  • You agree to provide true, accurate, current and complete information.
  • If, after investigation, KhojBiz has reasonable grounds to suspect that any member's information is untrue, inaccurate, not current or incomplete, KhojBiz may suspend or terminate that member's account and prohibit any and all current or future use of the KhjBiz sites (or any portion thereof) by that member other than as expressly provided herein.
  • Each member is wholly responsible for maintaining the confidentiality of account login and password information and for all activities occurring there under. KhojBiz cannot and will not be liable for any loss or damage arising from a member's failure to comply with this section, including any loss or damage arising from any member's failure to: (1) immediately notify KhojBiz of any unauthorised use of his or her password or account or any other breach of security; and (2) ensure that he or she exits from his or her account at the end of each session.

Registration

Your registration as a member of this Platform or the use of any of the features and services on this Platform either as a registered member or as an unregistered visitor constitutes acceptance of these Terms and Conditions and the Privacy Policy defined herein. These terms and conditions apply automatically to any new services and / or features introduced on this Platform.

Online registration

In order to become a KhojBiz member, you must first create a member account on this Platform by providing information about yourself. KhojBiz may check for the validity of the email addresses or mobile numbers. You should ensure that you do not in any manner provide false and / or inconsistent and / or untrue information.

Internet communication protocol information

The communication standards of the Internet industry transmit the URL of the website from which you visit this Platform, the IP address of your computer, the IP address of your ISP, various attributes of your computer such as operating system, resolution and browser software, and the date and time of your various requests for pages on this Platform. KhojBiz file logging system automatically logs all of this information in its log files for its analysis.

Password

You are advised to change your login password at regular intervals. Your password should be a combination of alphabets and at least one number and a special character. You are solely responsible for actions taken under your password, and should not disclose it to anyone else. You cannot use your password for any unauthorised purpose. KhojBiz shall neither be responsible nor liable for your non-compliance with the terms of password change.

Accessing and changing your account information

You can review the personal information you provided us and make any desired changes to the information, or to the settings for your account on this Platform, at any time by logging in to your account and editing the information on your profile page. You can also close your account through this Platform by sending your request to info@KhojBiz.com with your login email address. Your request will be processed within 7 business days.

Content removal and disabling or terminating your account

  • We can remove any content or information that you share on the KojBiz if we believe that it violates these Terms of Use, our policies (including our KhojBiz Guidelines) or we are permitted or required to do so by law. We can refuse to provide or stop providing all or part of the Service to you (including terminating or disabling your access to the KhojBiz) immediately to protect our services, or if you create risk or legal exposure for us, violate these Terms of Use or our policies (including our KhojBiz Guidelines), if you repeatedly infringe other people's intellectual property rights, or where we are permitted or required to do so by law. We can also terminate or change the Service, remove or block content or information shared on our Service, or stop providing all or part of the Service if we determine that doing so is reasonably necessary to avoid or mitigate adverse legal or regulatory impacts on us. If you believe that your account has been terminated in error, or you want to disable or permanently delete your account, consult our Help Centre at info@khojbiz.com . When you request to delete content or your account, the deletion process will automatically begin no more than 30 days after your request. It may take up to 90 days to delete content after the deletion process begins. While the deletion process for such content is being undertaken, the content is no longer visible to other users, but remains subject to these Terms of Use and our Data Policy. After the content is deleted, it may take us up to another 90 days to remove it from backups and disaster recovery systems.
  • Content will not be deleted within 90 days of the account deletion or content deletion process beginning in the following situations:
    • where your content has been used by others in accordance with this licence and they have not deleted it (in which case this licence will continue to apply until that content is deleted); or
    • where deletion within 90 days is not possible due to technical limitations of our systems, in which case, we will complete the deletion as soon as technically feasible; or
    • where deletion would restrict our ability to:
      • investigate or identify illegal activity or violations of our terms and policies (for example, to identify or investigate misuse of our products or systems);
      • protect the safety and security of our products, systems and users;
      • comply with a legal obligation, such as the preservation of evidence; or
      • comply with a request of a judicial or administrative authority, law enforcement or a government agency;
    • in which case, the content will be retained for no longer than is necessary for the purposes for which it has been retained (the exact duration will vary on a case-by-case basis).
  • If you delete or we disable your account, these Terms shall terminate as an agreement between you and us, but this section and the section below called "Our Agreement and What Happens if We Disagree" will still apply even after your account is terminated, disabled or deleted.

Applicable law

These Terms will be interpreted in accordance with the laws of Pathankot Jurisdiction, without regard to its conflict-of-law provisions. Users, suppliers and we agree to submit to the personal jurisdiction of a state court located in Pathankot for any actions for which the parties retain the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation or violation of a party’s copyrights, trademarks, trade secrets, patents, or other intellectual property rights.
